FIOS BUNDLE CUSTOMER AGREEMENT
THIS AGREEMENT CONTAINS IMPORTANT INFORMATION REGARDING
YOUR RIGHTS AND OBLIGATIONS AND VERIZON'S.
PLEASE REVIEW IT CAREFULLY.

1. This FiOS Bundle Customer Agreement (the "Agreement") sets forth the terms and conditions covering your purchase of a bundle of eligible services, as described in the marketing materials and/or in other information you received, that includes a combination of the following Verizon services ("VZ Services"): Verizon voice service (such as, the Verizon Freedom Essentials Plan which provides certain calling features and unlimited direct dialed local and long distance domestic calling), Verizon FiOS Internet, Verizon FiOS TV ("FiOS TV") services and/or Verizon ONEBILL. The Verizon companies that provide these services are identified in Exhibit A to this Agreement. Verizon FiOS Double Play ("FiOS DP") includes only two of the VZ Services except that a bundle including ONEBILL and two other VZ Services shall be considered a FiOS DP. Verizon FiOS Triple Play ("FiOS TP") includes Verizon voice service, FiOS Internet and FiOS TV service. The FiOS DP and FiOS TP options are each generally referred to in this Agreement as the "FiOS Bundle". FiOS DP and FiOS TP are available for a one year term. The services to which you have subscribed that are elements of the FiOS Bundle you selected are collectively referred to in this Agreement as the "Services". A copy of this Agreement also is available at www.verizon.com.
   
   
2. ACCEPTANCE
   
   
   1. Except in the case described in paragraph 2.B. below, you MUST accept this Agreement, either electronically or by returning the Customer Acceptance Form accompanying this Agreement, within 30 days of the later of (1) your order date or (2) the installation of all your Services. Verizon must receive your electronic acceptance or Customer Acceptance Form prior to the expiration of this 30 day period. If you do not accept this Agreement within this 30 day period, you will not receive the discounts associated with the FiOS Bundle you selected and you will be charged the existing higher, non-discounted month-to-month rates for your Services.
      
      
   2. If you ordered a FiOS TP that includes FiOS TV as a presale order (FiOS TV is not yet available in your area), you MUST accept this Agreement electronically within 30 days of the later of your order date or the installation of both other VZ Services in the bundle in order to receive the discounts associated with the FiOS Bundle you selected. If you do not accept this Agreement electronically within this 30 day period, you will not receive the discounts associated with the FiOS Bundle you selected and you may be charged the existing higher, non-discounted month-to-month rates for your Services.
      
      
3. EFFECTIVE DATE; MINIMUM TERM; APPLICATION OF DISCOUNTS
   
   
   1. This Agreement is effective beginning on the date you ordered your FiOS Bundle. The Agreement will terminate one year from the date that all the Services in your FiOS Bundle are fully provisioned (the "Minimum Term") or until terminated by the parties as permitted by this Agreement.
      
      
   2. You will begin receiving the discounts associated with your Services once all the Services have been provisioned and/or installed unless you ordered FiOS TP when FiOS TV is not yet available at your location. In that case, as explained in the confirmation letter you will receive from us, you will receive the FiOS DP discounts and an additional $5/month discount until FiOS TV service is provisioned, at which time you will begin receiving the FiOS TP discounts for the remainder of the Minimum Term.
      
      
   3. The cancellation or termination of only ONE-BILL that is part of a FiOS Bundle will result in automatically applying the applicable bundle discount for the remaining Verizon services that will form either a FiOS DP or FiOS TP. For example, if you subscribe to a FiOS Bundle consisting of ONE-BILL, Verizon voice service and FiOS Internet and ONE-BILL is cancelled or terminated, you will automatically receive the FiOS DP that consists of Verizon voice and FiOS Internet service. The applicable FiOS DP discount would be received for the remainder of your Minimum Term.
      
      
4. RATES, TERMS AND CONDITIONS FOR EACH SERVICE ARE PART OF THIS AGREEMENT
   
   This Agreement incorporates by reference all applicable agreements, tariffs and any other documents setting forth the rates, terms and conditions of each Service. This Agreement also incorporates by reference your order confirmation letter. If any terms of this Agreement conflict with the terms or conditions of any of the foregoing agreements or documentation, the terms of this Agreement shall control.
   
   
5. TERMINATION OF SERVICE; EARLY TERMINATION FEES
   
   
   1. After the Minimum Term, you will no longer receive the FiOS Bundle discounted rates for the Services and, unless otherwise agreed to or other discounts are made available by Verizon, your Services will automatically convert to existing higher, non-discounted month-to-month rates for the Services.
      
      
   2. AN EARLY TERMINATION FEE WILL APPLY IF YOU CHOOSE TO TERMINATE ALL OF THE SERVICES OR IF YOU CANCEL A SERVICE THAT IS PART OF THE FIOS BUNDLE BEFORE COMPLETING YOUR MINIMUM TERM, EXCEPT AS OTHERWISE PROVIDED IN THIS AGREEMENT.
      
      

      Early Termination Fee

   3. Other Provisions Relating To Early Termination Fees.
      
      
      1. Except as described in this paragraph 5.C. and in Section 6 below, the Early Termination Fee will not apply if you cancel any (or all) Services within 15 days after you have all Services in your FiOS Bundle installed.
         
         
      2. The Early Termination Fee will not apply if you cancel your FiOS Bundle or terminate a Service and, at the time of such termination, order and agree to a new FiOS Bundle. The Early Termination Fee will not apply if ONE-BILL is cancelled or terminated and you continue to subscribe to the remaining services in your FiOS Bundle for the Minimum Term.
         
         
      3. If you ordered FiOS TP that includes FiOS TV Pre-Sale and at the time of early termination only had two Services provisioned, the Early Termination Fee associated with the FiOS DP for the same contract term will apply if you had the two Services installed for more than 15 days.
         
         
      4. If you cancel one FiOS Bundle and move directly to another FiOS Bundle, a 15 day grace period for the Early Termination Fee does not apply and the applicable Early Termination Fee will apply if you terminate your new FiOS Bundle at any time prior to expiration of your Minimum Term.
         
         
6. OTHER SPECIAL PROVISIONS THAT APPLY TO FIOS TP CUSTOMERS WHO ORDER FIOS TV PRIOR TO THE AVAILABILITY OF FIOS TV AT THEIR LOCATION ("FIOS TV PRE-SALE")
   
   
   1. Early Termination Fees.
      
      
      1. Cancellation of only FiOS TV Presale order: If you cancel only your pre-sold FiOS TV service prior to its installation or within 15 days after installation, you will automatically receive the discounts associated with FiOS DP for the remainder of your Minimum Term.
         
         
      2. Cancellation of Verizon voice service and/or FiOS Internet Service Prior To FiOS TV Installation: If you cancel your Verizon voice service or FiOS Internet service more than 15 days after those services have been installed and before the pre-sold FiOS TV service is available and installed, you agree to pay the Early Termination Fee associated with FiOS DP and will be charged the existing higher, non-discounted month-to-month rates for the Services you keep.
         
         
      3. Cancellation of Services After FiOS TV Installation: If you cancel your FiOS TP, Verizon voice or FiOS Internet service within 15 days after the FiOS TV service is installed, you agree to pay the Early Termination Fee associated with FiOS DP for the same contract term and you will be charged the existing higher, non-discounted month-to-month rates for the services you keep unless you agree to a new FiOS Bundle as described above in paragraph 5.C. If you cancel your FiOS TP or any of the individual Services more than 15 days after FiOS TV is installed, you agree to pay the Early Termination Fee associated with FiOS TP and you will be charged the existing higher, non-discounted month-to-month rates for the Service(s) you keep unless you agree to a new FiOS Bundle as described above in paragraph 5.C.
         
         
7. TAXES AND FEES
   
   Verizon reserves the right to charge (and you agree to pay) all applicable taxes, surcharges and other fees. These taxes and fees may change during the term of this Agreement without prior notice to you.
   
   
8. OTHER PROVISIONS
   
   
   1. This Agreement is subject to Verizon's business policies, practices and procedures, which can change without notice. Unless otherwise prohibited by law, we can also change rates, terms and conditions in this Agreement at any time by sending you written notice prior to the billing period in which the changes would go into effect. If you choose to use your Services after that point, you are accepting the changes. If the changes have a material adverse effect on you, however, you can end the effected Service(s) without an early termination fee, by notifying Verizon within 60 days after we send notice of the change.
      
      
   2. In the event there is a ruling, regulation, or order issued by a judicial, legislative or regulatory body that causes Verizon to believe that this Agreement may be in conflict with such rules, regulations, and orders, Verizon may terminate or modify any or all of your Services and/or this Agreement immediately without notice.
      
      
   3. We reserve the right to modify this Agreement to reflect any change in any applicable tariff or underlying network service or component affecting the FiOS Bundle.
      
      
   4. Verizon's failure at any time to insist upon strict compliance with any of the provisions of this Agreement will not constitute a waiver of such terms in the future. If any provision of this Agreement is determined to be invalid, illegal or unenforceable, the remaining provisions will remain enforceable and the unenforceable portion shall be construed as nearly as possible to reflect the original intentions of the parties.
      
      
   5. You cannot assign this Agreement or any of your rights and duties under it. Verizon may assign all or part of this Agreement or your debts to us without notice, and you agree to make all subsequent payments as instructed.
      
      
   6. You agree that the substantive laws of the Commonwealth of Virginia, without reference to its principles of conflicts of laws, will govern the rights and obligations of all parties under this Agreement.
      
      
   7. This Agreement, including all documents incorporated into this Agreement by reference, including the terms of service for each of the individual Services, constitutes the entire agreement between you and Verizon with respect to the subject matter hereto and supersedes any and all prior or contemporaneous agreements whether written or oral. Any changes by you to this Agreement, or any additional or different terms in your orders, acknowledgements or other documents, written or electronic, are void.
      
      
   8. DISPUTE RESOLUTION: WE EACH AGREE TO SETTLE DISPUTES, EXCEPT AS PROVIDED BELOW, ONLY BY ARBITRATION. THERE IS NO JUDGE OR JURY IN ARBITRATION, AND REVIEW IS LIMITED, BUT AN ARBITRATOR CAN AWARD THE SAME DAMAGES AND RELIEF, AND MUST HONOR THE SAME LIMITATIONS IN THIS AGREEMENT AS A COURT WOULD. IF AN APPLICABLE STATUTE PROVIDES FOR AN AWARD OF ATTORNEY'S FEES, AN ARBITRATOR CAN AWARD THEM. WE ALSO EACH AGREE, TO THE FULLEST EXTENT PERMITTED BY LAW, THAT:
      
      
      1. EXCEPT FOR claims that may be heard by the small claims court in the state where the customer receives the services that are the subject of this agreement, THE FEDERAL ARBITRATION ACT APPLIES TO THIS AGREEMENT. ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT WILL BE SETTLED BY ONE OR MORE NEUTRAL ARBITRATORS BEFORE THE AMERICAN ARBITRATION ASSOCIATION ("AAA"). YOU CAN ALSO BRING ANY ISSUES YOU MAY HAVE TO THE ATTENTION OF FEDERAL, STATE, OR LOCAL GOVERNMENT AGENCIES AND THEY CAN, IF THE LAW ALLOWS, SEEK RELIEF AGAINST VERIZON ON YOUR BEHALF.
         
         
      2. YOU CAN OBTAIN PROCEDURES, RULES, AND FEE INFORMATION FROM THE AAA (WWW.ADR.ORG). THIS AGREEMENT DOES NOT PERMIT CLASS ARBITRATIONS EVEN IF THOSE PROCEDURES OR RULES WOULD.
         
         
      3. ANY ARBITRATION AWARD MADE AFTER COMPLETION OF AN ARBITRATION IS FINAL AND BINDING AND MAY BE CONFIRMED IN ANY COURT OF COMPETENT JURISDICTION. AN AWARD AND ANY JUDGMENT CONFIRMING IT ONLY APPLIES TO THE ARBITRATION IN WHICH IT WAS AWARDED AND CANNOT BE USED IN ANY OTHER CASE EXCEPT TO ENFORCE THE AWARD ITSELF.
         
         
      4. IF FOR SOME REASON THE PROHIBITION ON CLASS ARBITRATIONS SET FORTH IN PARAGRAPH 8.H.2. ABOVE IS DEEMED UNENFORCEABLE, THEN THE AGREEMENT TO ARBITRATE WILL NOT APPLY. FURTHER, IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN THROUGH ARBITRATION, WE EACH WAIVE ANY TRIAL BY JURY.
